Zanu PF MP Tsungai Makumbe Acquitted of Rape Charges Against Ex-Wife

Tsungai Makumbe, a Zanu PF MP, has been acquitted of rape charges involving his ex-wife. The magistrate ruled the state failed to prove the case beyond reasonable doubt, citing inconsistencies in the complainant’s testimony. The alleged incident occurred in November 2022, but was not reported until September 2023.

In a recent ruling, Mazowe North Member of Parliament Tsungai Makumbe (Zanu PF) was acquitted of charges alleging he raped his 23-year-old ex-wife at gunpoint. Harare magistrate Clever Tsikwa concluded that the prosecution had not established the case beyond reasonable doubt. The accusations stated that the assault led to an unintended pregnancy and exposed the victim to a chronic illness.

The alleged incident occurred in Mt Pleasant in November 2022. Prosecutors claimed that Makumbe approached the complainant at approximately 10 PM and summoned her to meet him at the gate, after which she entered his vehicle. Reports indicated that he displayed a handgun before demanding sexual intercourse.

According to the prosecution, Makumbe purportedly twisted the complainant’s leg, forcing her to exit the vehicle and comply with his demands. He allegedly assaulted her without protection. The victim, however, did not report the incident immediately, claiming that Makumbe later provided her with $20 to purchase morning-after pills.

After receiving medical treatment at Parirenyatwa Hospital, where she was diagnosed with a chronic disease, the complainant formally reported the case on September 2 of this year. Magistrate Tsikwa emphasized the lack of evidence supporting the claims, acknowledging significant inconsistencies within the complainant’s testimony. He stated that her narrative contained numerous inconsistencies and deliberate misrepresentations of Makumbe’s actions. Lawyer John Ndomene represented the accused throughout the proceedings.

The acquittal of Tsungai Makumbe on rape charges underscores the challenges faced in legal cases involving serious allegations. The court’s findings highlighted significant inconsistencies in the complainant’s account, leading to questions regarding the credibility of the accusations.
